ohn Dutton was 11 years old when his grandmother named him in
her will on 4 May 1660. He had inherited about one half of his
grandmother's estate and his Aunt Elizabeth the other half with
a very small portion being left to his mother, Ellin, and to
her two other grandchildren, Thomas and Robert. Her son, John
Dutton of Overton, had preceeded her in death having died in
1659. "In her will she directs that her grandchild John
have for life 'not only for the love I beare him' but also in
full satisfaction of his child's part of her late husband's goods
the tenements belonging to Earl Rivers [Thomas Savage, 3rd Earl
Rivers] and to Mr. Garrard. At sixteen, he is to have half her
living, the other half being reserved for her daughter Elizabeth,
until John is twenty-one. At that time, he is to receive Elizabeth's
half of the living paying her ...[illegible] pounds. Elizabeth
is also at that time to receive all her goods, cattle, and chattels,
the 'cubbort, the birchboxe, the table in the house &...the
third part of my shope and all my husbandrie ware...' Elizabeth
is bequeathed all her money in bills, bonds, and other debts,
and is to maintain her grandchild until he is sixteen with 'meate,
drinke, and apparell as befitts his calling.' Mr. James Garrard
and Richard Smyth are appointed overseers of her grandchild when
he reaches fourteen. If her grandchild, John Dutton, were to
die before marriage, her daughter Elizabeth is to have her living
for life. To her daughter-in-law, Ellin, she left 12 pence; to
her grandchild, Thomas, one cow; and to her grandchild, Robert,
12 pence. Finally, she appoints her daughter, Elizabeth Dutton,
and Mr. James Garrard as her executors, and signs the will by
mark." (TAG)
